1. Acceptance of Terms

By accessing and using Avolal ("the Service", "we", "us", or "our"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

2. Description of Service

Avolal is a flight booking platform that provides:

  • AI-powered natural language flight search
  • Flight comparison and booking services
  • Travel preference management
  • Booking management and customer support

We act as an intermediary between you and airlines/travel service providers. We do not operate flights or control airline operations.

3. User Accounts

3.1 Account Creation

To use our Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your account information
  • Maintain the security of your password and account
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

3.2 Account Eligibility

You must be at least 18 years old to create an account and make bookings. By creating an account, you represent that you meet this age requirement.

4. Bookings and Payments

4.1 Pricing

All prices are displayed in your selected currency. Prices include applicable taxes and fees at the time of display. Final prices may vary due to currency fluctuations, fare changes, or seat availability until payment is confirmed.

4.2 Payment Processing

We use secure third-party payment processors (Stripe) to handle payments. By making a booking, you agree to:

  • Provide valid payment information
  • Pay the full amount at the time of booking
  • Authorize us to charge your payment method
  • Accept responsibility for any payment processing fees

4.3 Booking Confirmation

A booking is only confirmed when you receive a confirmation email from us. We reserve the right to cancel any booking if payment fails or if there are issues with the airline or service provider.

5. Cancellations and Refunds

5.1 Airline Policies

Cancellation and refund policies are determined by the airline and fare type you selected. We display these policies before booking. Some tickets are non-refundable or may incur cancellation fees.

5.2 Refund Processing

If you are eligible for a refund according to airline policies, we will process it within 7-14 business days of approval. Refunds are issued to the original payment method. Processing times may vary by financial institution.

5.3 Service Fees

Our service fees are generally non-refundable, except in cases where we cancel a booking due to our error or technical issues.

6. Travel Documents and Requirements

You are responsible for:

  • Ensuring you have valid passports, visas, and travel documents
  • Meeting all health and vaccination requirements
  • Arriving at the airport with adequate time before departure
  • Complying with airline baggage policies
  • Following all airline and airport rules and regulations

We are not liable for denied boarding or travel due to inadequate documentation or failure to comply with requirements.

7. User Conduct

You agree not to:

  • Use the Service for any illegal or unauthorized purpose
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Service or servers
  • Use automated systems (bots, scrapers) without permission
  • Impersonate any person or entity
  • Transmit any viruses, malware, or harmful code
  • Make fraudulent bookings or provide false information
  • Resell tickets booked through our Service without authorization

8. Intellectual Property

All content on Avolal, including text, graphics, logos, icons, images, audio clips, digital downloads, and software, is the property of Avolal or its content suppliers and is protected by international copyright laws. You may not reproduce, distribute, modify, or create derivative works without our written permission.

9. Limitation of Liability

9.1 Service Availability

We strive to provide reliable service but cannot guarantee uninterrupted or error-free operation. We are not liable for service interruptions, technical issues, or third-party failures.

9.2 Third-Party Services

We act as an intermediary for airline and travel services. We are not responsible for airline delays, cancellations, lost baggage, flight changes, or any other issues arising from third-party service providers.

9.3 Damages

To the maximum extent permitted by law, Avolal shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability or fitness for a particular purpose
  • Warranties that the Service will be error-free or uninterrupted
  • Warranties regarding the accuracy of pricing or availability information
  • Warranties regarding third-party services or content

11. Indemnification

You agree to indemnify, defend, and hold harmless Avolal, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, violation of these Terms, or violation of any rights of another party.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by email or through the Service. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

13. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including violation of these Terms. You may also terminate your account at any time by contacting us. Upon termination, your right to use the Service will immediately cease.

14. Dispute Resolution

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Spain, without regard to its conflict of law provisions.

14.2 Arbitration

Any disputes arising from these Terms or use of the Service shall be resolved through binding arbitration, except where prohibited by law. You waive the right to participate in class-action lawsuits.
